Each week a summary report is posted on this page that includes the status of enforcement actions (first available with the February 7, 2010 summary report), recorded requests for information, and reported complaint data on potential noncompliance with the N.C. Smoke-Free Restaurants and Bars law. Reported complaint dates details are shared with local health departments, which are authorized to enforce the law with businesses. Please keep in mind that a complaint is not a confirmed violation of the law.

NOTE: Violation(s) of the law by the business has the following penalties:

First Violation: Written notice to the person named in violation and advisement of action to be taken in the event of subsequent violations.
Second Violation: Written notice to the person named in violation and advisement of administrative penalties to be imposed for third and subsequent violations.
Third and Subsequent Violations: Administrative penalty of not more than two hundred dollars ($200.00) to the person named in violation. Each day on which a violation of this law or rules occurs may be considered a separate and distinct violation.
